Reference: What is a unique defense? Reference information: Named Plaintiff Subject To Unique Defense Is Not Adequate Class Representatives In CE Design Ltd. v. King Architectural Metals, Inc., No. 10-8050, 2011 WL 938900 (7th Cir. Mar. 18, 2011), the Seventh Circuit addressed a complaint brought under the Telephone Consumer Protection Act (TCPA) by a company that, “unusually for a business firm, is an avid class-action plaintiff,” having filed at least 150 TCPA class actions. The Seventh Circuit vacated class certification, finding a plaintiff cannot be an adequate class representative if it is subject to a defense that would not defeat the claims of unnamed class members. Here, CE Design had agreed to the publication of its fax number in a business directory that could be deemed to constitute consent to the receipt of faxes. Under the TCPA, consent is a defense to a TCPA claim. Thus, the court remanded the matter to the district court to address whether the fact that the named class representative’s claim was significantly weaker than claims of other class members justified the denial of certification. https://jenner.com/resource_centers/update/72 So "not subject to unique defenses" means that the class representative's claims could not be countered using a defense (excepción) that does not apply to the other class members.
