As in the US, there may be excuses for your failure to file that justify the court in letting you file even though you missed the deadline. Those excuses are called "exceptions," hence the proposed translation. You can rework it for the various configurations of the term in the source text: they request that the court grant them an exception to the time bar on the basis of of article X... they seek leave to file on the grounds that an exception to the time bar applies/that their claim is not time-barred due to the exception set forth in article X...
