O vício de produto ou de serviço restringe-se ao uso e funcionamento do bem, não atingindo a integridade física do consumidor. É um problema ou “defeito” que não extrapola, impede ou compromete o simples uso do bem – como, por exemplo, a TV que não funciona ou o fogão que não acende. Nos casos de vícios, o importador continua sendo responsável, mas a lei agora faculta ao consumidor incluir o comerciante como responsável solidário, pois estão envolvidos na cadeia produtiva e distributiva.
