Need to retain the word "easement", i.e. "right of way easement".

A right of way is a type of easement that allows a person to pass through another's land. Typically, a right of way easement is a roadway or pathway for travel through another's property that benefits a particular person or benefits another parcel of land.

I now think that Germaine should have posted and received points for the answer that she gradually led me to (the "gradually" being totally due to my slowness in accepting the importance of her point). However, as she didn't, I've edited the header source term to reflect how it should have been parsed and posted the target term as amended, rather than my original suggestion.

agree  Tony M: Although the significance is a bit more that just that: 'à talon' means 'foot traffic', and refers equally to animals 'on the hoof' as well as humans! Legalese is not anatomically accurate, but it means 'anything on foot'.

-> Thanks Tony. That's odd, given that hooves are toes, not heels. What about dogs? flocks of sheep? horses being led, not ridden?

neutral  Germaine: The "right of way" (droit...) is an advantage/benefit; the "easement of way"(servitude) is an encumbrance. Ces termes ne sont pas interchangeables. // I didn't catch that "right of way easement" was a new answer; please post it.

-> OK, I accept that it can't just be right of way and that "easement of way" can be a valid wording. So, why don't you post the answer?

disagree  GILLES MEUNIER: traduction de droit de passage

-> An easement is granting something: in this case it's granting a right of way.

neutral  Daryo: needs more checking - not to be confused with the "right of way" when there is a footpath open to the public // makes a hell of a difference for the owner of the land!!!
2 days 23 hrs
-> That would be a public right of way or a public footpath.

neutral  AllegroTrans: there is more to it than this and great care needs to be taken here, this is legal stuff

(contexte) [A] public easement is one the right to the enjoyment of which is vested in the public generally or in an entire community; such as an easement of passage on the public streets and highways or of navigation on a stream.

SYNONYMES: easement of passage (295)

(contexte) The public rights which most closely resemble easements are public rights of way. The land over which a public right of way exists is known as a highway; and although most highways have been made up into roads, and most easements of way exist over footpaths, the presence or absence of a made road has nothing to do with the distinction. There may be a highway over a footpath, while a well-made road may be subject only to an easement of way , or may exist only for the landowner's benefit and be subject to no easement at all.

agree  Daryo: yes, there is a distinction to be aware of - "rights" limited to owners of an enclaved neighbouring land and " right-of-way" given to any member of the public.
22 hrs
