Me parece que tu opción es válida.

Pero en vez de "afirman", creo que se trata de una "reivindicación" o hasta "reclaman".

Y con algo más de contexto, casi sería "imponen" (como condición).

Es decir, "lo cual dicha partes imponen como condición..." (en vista del incumplimiento...)
