Jusqu’alors en effet, de tels manquements ne pouvaient être sanctionnés que par le recours à l’arme lourde du délit **d’opposition à fonction** visé à l’article L. 450-8 du Code de commerce – toujours en vigueur – qui impose l’ouverture d’une enquête pénale et la saisine du parquet.
