desistimiento de la propiedad

Thanks for the discussion. As to related passages, I found two where reference is made to "desistir". Evidently, the context broadly speaking is the entire contract, but it has clauses that are probably irrelevant. Besides, I wouldn't be able to provide it because it's under an NDA. All told, after going back to the source and reading the comments, I'm more inclined towards the withdrawal on the part of the buyer. Once again, thanks to all.

It's unclear what the Asker means with "related passages" - are they taken from this particular section or a later/earlier one?

As you know, to cover all eventualities contracts generally define what occurs when one of the parties withdraws from the contract and the context we're quoted certainly covers withdrawal on the part of Buyer and I assume this particular title/article covers withdrawal on the part of Seller.

I agree that "propiedad" often refers to the building's owner in Spanish real estate contracts, so the idea you've given is certainly a possibility.
However, the context of " ... no se formalizase la escritura pública de compraventa de la entidad correspondiente por desistir de su otorgamiento el potencial comprador" would suggest a withdrawal by the buyer rather than the owner. Any ideas?
As it's only a heading, I might be inclined to hedge here and just leave it as "withdrawal".

There's no need to "guess".

As I mentioned below, "propiedad" here does not refer to the property as such but to the owner of the property - i.e. a person (or company). It's fairly standard usage, and not only in contracts - a headline from a newspaper "La propiedad deberá derribar un edificio en ruinas en A Moureira" - It's obvious here that the word refers not to the building but to the owner(s) of the building.

So, this point of the agreement deals with the term of the contract, withdrawal on the part of the seller and early termination.

"La propiedad" here refers not to the "property" but to the owner of the property.
For example:

"La propiedad se reserva el derecho de modificar las condiciones generales en cualquier momento (...)"

In contracts "propiedad" is probably more frequent than "propietario".
