I’m struggling with the term “privilegierte Arbeitnehmerhaftung” in a company car agreement. Although it seems to be a regular term in German, I have not come across any translation or corresponding English term.

Here is the context: “Der Arbeitnehmer haftet für alle vorsätzlich verursachten Beschädigungen des Kraftfahrzeuges auf Schadensersatz. Das gilt auch für Fälle grob fahrlässig verursachter Beschädigungen; allerdings gelten in einem solchen Fall die durch die Rechtsprechung aufgestellten Grundsätze der ***privilegierten Arbeitnehmerhaftung*** dann, wenn der Schaden höher als drei durchschnittliche Bruttoentgelte ist.”

I discussed the issues with colleagues in the ITI German netwoirk where we came to the conclusion that it needs an explanation. This is what the final translation looks like: "According to case law however, the employee’s liability will be limited if the damage exceeds the average of three gross monthly salaries. This is known as the principle of ‘privileged employee liability’ (privilegierte Arbeitnehmerhaftung)."
