An employee (a 'chargé d'affaires' for an asset management company) is going to be dismissed but the employer has agreed to extend his notice period for the benefit of both parties. During this period, the employee will be entitled to variable remuneration, the gross amount of which will be 'XXX% x Encours levé si Encours levé est strictement positif'. The document goes on to define 'Encours levé' as follows: 'L’Encours levé se définit selon le process suivant :

- [Employer] et M. XXXX établissent la liste de clients existants couverts par M. XXXX au 30 juin 2017 (ci-après, la « Liste Initiale Client », annexée au présent avenant) ;

- Pour chacun des clients de cette Liste Initiale Client, le nombre de parts détenues au 30 juin 2017 dans chaque OPC géré par [Employer] (ci-après le « Nombre de parts initial Client_n ») est constaté soit par attestation dépositaire, soit par mail du client à [Employer].Dans le cas où ni une attestation dépositaire, ni un mail du client ne viendrait attester du nombre de parts détenues au 30 juin 2017 par un client, ce client serait exclu du calcul de l’Encours levé.

- Au dernier jour ouvré du mois de novembre 2017, soit le jeudi 30 novembre 2017, ou bien au dernier jour ouvré du mois civil suivant le dernier jour effectivement travaillé par M. XXXX si ce dernier jour effectivement travaillé intervient avant le 30 novembre 2017 à la demande d’[Employer] (la date applicable étant désignée ci-après comme « Date de Fin de Période ») :

o Pour chacun des clients de la Liste Initiale Client et chaque nouveau client apporté par M. XXXX (un nouveau client étant défini comme n’ayant aucun encours dans les OPC [Employer] au 30 juin 2017) et validé par la Direction sur la base des rendez-vous clients et démarches effectués dans le cadre des modalités et autorisations règlementaires de commercialisation applicables à [Employer] et aux OPC visés et enregistrés dans l’outil de suivi commercial Salesforce, ci-après, ensemble, « les Clients », le nombre de parts détenues à la Date de Fin de Période (ci-après, le « Nombre de parts Client_n _Date de Fin de Période ») est calculé sur la base des attestations de détention en Date de Fin de Période reçues par [Employer], des Clients ou de leur dépositaire.

o Pour chaque Client, pour chaque OPC, la variation (positive ou négative) par référence au 30 juin 2017 (ci-après, le « Delta Nbre de parts Client_n initial_Date de Fin de Période ») du nombre de parts détenues est calculée comme suit :

- Nombre de parts initial Client_n

o Sur la base des dernières Valeurs liquidatives officielles à la Date de Fin de Période (ci-après, la « Valeur Liquidative de l’OPC_Date de Fin de Période »), la variation d’encours (ci-après, le « Delta Encours Client_n_ Date de Fin de Période ») est mesurée pour chaque OPC par le calcul suivant :

Delta Encours Client_n_ Date de Fin de Période
= Delta Nbre de parts Client_n initial_Date de Fin de Période
x Valeur Liquidative de l’OPC_Date de Fin de Période

o Il en résulte que Encours levé = Somme des Delta Encours Client_n _Date de Fin de Période.'

The idea is simple enough: the employee will be paid on the basis of the amount of additional funds he/she has collected during the stated period. There is no standard or special term for this AFAIK.

(I toyed with "funds raised", but that sounds a bit too much like something a charity does…)
