it doesn't say anywhere that all unsecured debts are unenforceable [IOW "unsecured debts" and "unenforceable debts" are NOT two synonyms to chose between on the basis of "which one you like"] it only says that these "claims company" grossly exaggerate their skills at finding mistakes in the wording of unsecured loan agreements that would render them unenforceable (which by implication means that "unsecured debts" normally ARE enforceable)

"unsecured" debt means "not guaranteed by some collateral" which still doesn't prevent the lender from obtaining an enforceable judgement against the debtor [= "un titre exécutoire"] if the whole business ends up in front of a judge.

In practical terms a secured debt is far easier to collect, but an unsecured debt is still enforceable [until it becomes statute barred], i.e you can obtain an executable judgement against the debtor (deciding if it's worth the effort in a specific case is another matter, but the possibility is there).

More important point of method: the "Chinese metaphysics" method is a pointless / useless method - combining the encyclopaedia entries for China and for metaphysics will tell you NOTHING about "Chinese metaphysics" - [no point combining possible meanings of each separate part of a term] you need an explanation for a term (a) as a whole (b) as used in the relevant context, here as in:

I found this in an article on the BBC from 2010 http://news.bbc.co.uk/2/hi/business/8507054.stm. It uses "unsecured".

"Beneficial Claims says it uses mistakes in credit agreements to get unsecured debts, such as credit cards and loans, declared "unenforceable" by lenders."

I prefer this rather than "unenforceable", because the debt collector is going to try to "enforce" them. For me "secured debt" means there is collateral, but credit card debt and consumer loans are indeed not "secured" by collateral. So it might work. I am going to notify the client that there some doubt. Enormous thanks to all!

collecting unenforceable debts is a booming business in UK ...

I can see why la commission de Surendettement de la Banque de France would disregard them - although they are existing debts, they are unenforceable and no one sane being in a situation of "Surendettement" would pay them nor could expect from anyone sane any help to pay them.

Thanks all. I asked a French lawyer who works in the field and he had never heard this term and suspects it is the same as "créances non titrisées" and suggests "unsecuritised receivables". This strikes me as better than "unsecured"

I think you need to consider the meaning of "créance titrée". Undocumented does not seem correct; if a debt is entered in a ledger somewhere, it is documented. Further, no entity seeking to recover debts could consider recovering a debt that is not doumented. That meaning just does not stick for me.
I'm leaning towards Tony's "unsecured debt". Perhaps you could check with the client.

I have and I come up with "debt security" or "debt instrument." But I don't really have the courage yet to use "Unsecured Residuals" or "Unsecured Debt." Would you have the courage to use these?

Perhaps you could try searches for "créance":
- titrée
- avec titre
- sans titre
or "titre de créance".
I think it will help if you consider the function of a titre, i.e. to demonstrate something such as type, veracity, existence, amount, etc. This forum may help:
