legal remedy / judicial relief or remedy Explanation: https://en.wikipedia.org/wiki/Legal_remedy A legal remedy, also judicial relief or a judicial remedy, is the means with which a court of law, usually in the exercise of civil law jurisdiction, enforces a right, imposes a penalty, or makes another court order to impose its will. In common law jurisdictions and mixed civil-common law jurisdictions, the law of remedies distinguishes between a legal remedy (e.g. a specific amount of monetary damages) and an equitable remedy (e.g. injunctive relief or specific performance). |

administration of justice Explanation: From what I have read in different articles on the subject, it looks like "prestação jurisdicional" has to do with administration of justice. In "O acesso à justiça e a prestação jurisdicional do Estado", the author quotes from a book by the STF Chief Justice: “O direito à jurisdição é o direito público subjetivo constitucionalmente assegurado ao cidadão de exigir do Estado a prestação daquela atividade. A jurisdição é, então, de uma parte, direito fundamental do cidadão, e, outra, dever do Estado." Compare with this definition of administration of justice: "The administration of justice is the process by which the legal system of a government is executed. The presumed goal of such administration is to provide justice for all those accessing the legal system." Aren't they talking about the same thing? It seems to me that something went haywire in the legal system to where the defendant didn't have full access or something else, thus causing the final decision to be reversed. That's my reading of it. https://rafaelacanabrava.jusbrasil.com.br/artigos/112287149/o-acesso-a-justica-e-a-prestacao-jurisdicional-do-estado-breves-consideracoes https://en.wikipedia.org/wiki/Administration_of_justice |
