against a party Explanation: This principle does not apply, however, if, as here, the defendant asserts a variety of claims (various different claims) against a party in an impermissible manner, [namely] in a contingent relationship. (Die Beklagte ein Partei Begehren stellt = The defendant asserts claims against a party.) (Admittedly, I did not read the references, but this is my more-than guess based on experience with legal procedure translations.) -------------------------------------------------- Note added at 4 hrs (2017-07-09 19:49:48 GMT) -------------------------------------------------- Alternative: This principle does not apply, however, if, as here, the defendant asserts a variety of claims (various different claims) against a party in an impermissible manner, [namely which claims have] a contingent mutual relationship. -------------------------------------------------- Note added at 11 hrs (2017-07-10 02:45:31 GMT) -------------------------------------------------- Responding to Mr. Vrooman: I agree this is not especially German -- high, low, or intermediate -- but I am trying to discern what it meant. Responding to Mr. Conrad: I agree that, even conceding the ein versus eine problem, it is possible that the author means by "die Beklagte ein Partei" "the Defendant, a party in the case". I think my solution is equally acceptable as also toleration of bad German. Maybe the Asker can clarify the question of whether the author is susceptible to using bad German, or is trying to get away with using bad German. |
