On appelle également cette procédure "référé". Les conditions d'un référé sont l'urgence, le caractère provisoire de la décision et le fait que la décision ne porte pas préjudice à l'affaire. Quelques exemples : ordonner une expertise ou l'audition d'un témoin. Le président du tribunal de commerce ou le président du tribunal du travail peut également prendre de telles décisions sur des matières qui sont de la compétence de son tribunal."

  -> thanks for your agree but I now think that Chambre du Conseil doesn't mean "chambers" even though the hearing quite probably was "in chambers" (i.e. closed to the public and press)

neutral  mrrafe: I think the difference between the Brussels venue and US/UK "in chambers" is that the latter means the judge's private office, whereas BRX gives that office the name of a formal court (Council Chamber or court of 1st instance). So I'd say Council Chamber.

I answered this a few minutes ago but the initial question meanwhile disappeared along with my answer. Will try to recreate it as follows:

This question was answered in 2005. I don't know how to find the ProZ URL but the 2005 answer is here:

I don't know why the 2005 answerer felt it necessary to read "refere" as "ayant entendu" in order to be more archaic.

The 2005 translation of the name of the court as "Court of First Instance" is more a functional description of the court; I would use the actual name, i.e., Council Chamber or Chamber of Council, which seem to be an EN or informal style and a FR style respectively.

Will try to relocate cites for those two names momentarily.

  -> Initially yes, thanks. I do now believe Chambre de Conseil necessarily implies refere which in turn means closed session, expedited, interim/provisional. This is after re-reading the dictionnaire-juridique cite above.
