Damages - не только то, что назначает суд, это ущерб, а суд является тем, кто определяет размер (в теории настоящего) ущерба. Можно сказать, чтобы отличить судебного определения этой суммы от внешней реалии "percentage of the amount of damages [actually] sustained..."

You're misreading it. "Damages attempt to measure in financial terms the extent of harm a plaintiff has suffered because of a defendant's actions." Pretty straightforward. It's just the first reference I opened. "Damages ACTUALLY sustained" is inarguable in its meaning.

You're still looking for legal language; I don't think you WANT the source you're asking for. You want legal/court language specifying actual damages. Anything else would be inappropriate fo your purposes.

Asker: Спасибо за ответ. Но согласиться с Вами не могу. ВСЕ определения damages в словарях напрямую упоминают суд. Если сможете дать ссылку на определение этого понятия в вашей интерпретации, буду очень благодарна. Мне такое найти не удалось. Но, может, я плохо искала.
