Article 1 / NATURE ET ETENDUE DE LA GARANTIE

Nous garantissons l’assuré contre tout refus de l’assuré d’occupation de la location saisonnière pour non-conformité substantielle de celle-ci au regard de la description qui en était faite sur l’annonce par l’organisme de locations saisonnières ou par le particulier bailleur à partir de laquelle l’assuré à souscrit le contrat de location.

Par "non-conformité substantielle", il faut entendre :

- des défauts d’une telle ampleur et d’une telle durée qu’ils rendent impossible le séjour dans des conditions normales d’usage ;

- Concernant les biens ou de services ou équipements attachés à la location et listés au sein de l’annonce qui représentent une véritable valeur ajoutée à la location et qui ont été déterminants dans le choix de l’assuré :

• leur absence constatée lors de l’entrée dans les lieux, le premier jour de la location

• leur défaut de fonctionnement constaté lors de l’entrée dans les lieux, le premier jour de la location.
