Jedna od najznačajnijih novina u domaćem krivičnoprocesnom pravu je uvođenje stručnog savetnika u krivični postupak, kao lica koje raspolaže stručnim znanjem iz oblasti u kojoj je određeno veštačenje. Oblast psihijatrijskog veštačenja predstavlja veoma kompleksnu i složenu problematiku. Imajući u vidu praktičnu vrednost rezultata psihijatrijskog veštačenja kao i činjenicu da nalaz i mišljenje veštaka psihijatra ima značajno mesto u dokaznom postupku, to će predmet izlaganja biti problematika koja se odnosi na krivičnoprocesni položaj stručnog savetnika kao subjekta psihijatrijskog veštačenja.

Izgleda da se odomaćio prevod "expertise", ali mi se čini previše opšte prirode.

Veštak je definitivno "expert witness".

* (1)  Ako je kod optuženog nakon učinjenja krivičnog djela nastupila takva duševna bolest da nije sposoban učestvovati u postupku Sud će rješenjem, nakon psihijatrijskog vještačenja, prekinuti postupak i optuženog uputiti organu nadležnom za pitanja socijalnog staranja.

PROCEDURE FOR APPLICATION OF SECURITY MEASURES, FORFEITURE OF PROPERTY GAIN AND REVOCATION OF SUSPENDED SENTENCE
Article 388
Adjournment of the Procedure in Case of a Mental Illness
(1) If the accused becomes affected by such a mental illness after the commission of a criminal offense that he or she is unable to take part in the procedure, the Court shall, upon psychiatric forensic evaluation, adjourn the procedure and send the accused to the body responsible for issues of social care.
