I'm translating a company profit sharing agreement. When payments are made, the contract states that the following information be sent to employees eligible for profit-share bonus payments:

 le montant global de l'intéressement ;
 le montant moyen perçu par les bénéficiaires ;
 **le montant des droits attribués à l'intéressé** ;
 la retenue opérée au titre de la CSG et de la CRDS

What do we term these "droits"?

Asker: Agreed, in this situation "droits" does not mean "rights". (Rather like confusion over the term "royalties" ("droits d'auteur"), they emanate from copyright ("droit d'auteur") but the two are not the same).

A l'heure actuelle, la participation est obligatoire dans les entreprises de plus de 50 salariés qui ont réalisé un bénéfice au cours de l'année précédente, de sorte qu'environ 5 millions de salariés sont actuellement concernés par ce système. Le mode de calcul de la réserve spéciale de participation, défini par l'ordonnance de 1967, s'impose aux entreprises. Le montant des primes de participation versées aux salariés varie en fonction des résultats annuels de l'entreprise. Elles sont investies en valeurs mobilières (actions de l'entreprise, parts de SICAV ou de fonds communs de placement d'entreprise, actions émises par les sociétés créées par des salariés en vue du rachat de leur entreprise...) dans le cadre d'un plan d'épargne d'entreprise ou versées sur un compte courant rémunéré. Leur montant maximal est de 86.820 F par an et par salarié. Elles sont exonérées d'impôt, mais restent bloquées pendant une durée de cinq ans sauf circonstances exceptionnelles (mariage, divorce, naissance d'un troisième enfant, départ de l'entreprise...).

L'intéressement, qui est facultatif, touche près de 3 millions de salariés. La prime versée à chaque salarié est liée à la réalisation d'objectifs choisis dans l'entreprise et ne peut être supérieure à 86.820 F par an. Elle est imposable, sauf si elle est versée sur un plan d'épargne d'entreprise où elle est indisponible pendant une durée de cinq ans. En conséquence, un grand nombre d'entreprises ont mis en place à la fois un dispositif d'intéressement et un plan d'épargne d'entreprise.

Les plans d'épargne d'entreprise reçoivent les primes de participation et, le cas échéant, les primes d'intéressement ainsi que les versements volontaires des salariés, qui peuvent donner lieu à un abondement versé par l'entreprise. Le montant de ce dernier est limité à 15.000 F par salarié et par an, et ne peut excéder le triple de la contribution du salarié. Par ailleurs, le total des sommes versées sur le plan est plafonné au quart de la rémunération annuelle du salarié. Les sommes recueillies sur ces plans sont investies, pour le compte des salariés, en valeurs mobilières (actions de l'entreprise, parts de SICAV ou de fonds communs de placement...).
