on pain of forclosure Explanation: Note that, in the case of a mortgage etc. what is foreclosed on is the loan, not the house. As the house is the security for the loan, that is what is then taken. "Under penalty of foreclosure" seems to me not to be the natural way of putting this in English. https://books.google.co.uk/books?isbn=0324650205 Marianne Jennings - 2007 - Business & Economics ... and the Hulls, the bank was quite within its rights in asking that the loans involving all three properties be made current, on pain of foreclosure if they were not. www.bankruptcylawnetwork.com/bankruptcy-rule-3002-1-an-unli... the bankruptcy was completed, the bank would demand hundreds or even thousands of dollars in fees to bring the account current, on pain of foreclosure. -------------------------------------------------- Note added at 12 hrs (2017-04-04 10:21:08 GMT) -------------------------------------------------- Sorry, that should have been foreclosure, not "forclosure"! -------------------------------------------------- Note added at 13 hrs (2017-04-04 11:19:00 GMT) -------------------------------------------------- "On pain of" is not "definitely British English" at all, as the following examples demonstrate (unless Massachusetts and Long Island have been transported to the UK): caselaw.findlaw.com › Caselaw › Massachusetts › MA Ct. App.... in asking that the loans involving all three properties be made current, on pain of foreclosure if they were not. See Mechanics Natl. Bank v. Killeen, 377 Mass. iarchives.nysed.gov/xtf/view?docId=tei/A1877/NYSA_A1877-78_V16_pt4...... bouwery and cattle at the Walebocht on Long Island, passed to the late Isaac Allerton, and by him assigned to Wallewyn van der Veen, on pain of foreclosure. www.law.nyu.edu/sites/default/files/.../Bankruptcy_McKenzie... all three suits w/ exception of one claim, and having creds. reduce claims in exchange for debtor's having 9 mos. to sell or refinance on pain of foreclosure. |
