La garantie d'une police base réclamation est accordée pour les réclamations survenues pendant la période de validité du contrat, même si le fait générateur ou le dommage sont antérieurs à sa prise d'effet.

La loi a également prévu le cas où deux contrats en « base réclamation » se succèdent, avec une réclamation pendant le délai subséquent du premier. Si, lors de la souscription du second, le souscripteur ignorait le fait dommageable, la condition de reprise du passé est remplie et l'on a un cumul.
