M_a_a, Happy New Year to you, too! The words ‘jointly and severally’ (when they are used together) are normally used – most commonly – when referring to liability. If Ioanna’s text referred to liability, I would have said that the Greek words, ‘από κοινού και κατά μόνας’, would have to be translated as ‘jointly and severally’, definitely. However, since Ioanna’s text does not refer to liability, I, personally, would prefer to translate the Greek words in another way. I am merely stating my opinion. You and Ioanna are naturally free to do whatever you like.

I believe your last entry (the one where you addressed me) is slightly irrelevant within the context of this discussion.

I'm not referring to examples where either of the words "jointly" or "severally" have been used to connote a meaning other than the one they usually do. Whether two guys are "jointly liable" or have jointly committed some kind of offence, the literal meaning of the adverb does not vary (i.e. with another person or people; together), and the same goes for "severally".

Our debate is with regard to the collocation, not the connotation, of words.

So those examples that I'm referring too are merely instances where the words "jointly" and "severally" appear in a different context than the one they usually do, still, however, connoting their good old ordinary meaning. So, I stand by what I said: should the asker opt for saying "jointly and severally", I cannot imagine how this phraseology could be considered open to misinterpretations...

The fact that you can find many examples of something written in a certain way on the Internet does not necessarily confirm that those words really apply in the circumstances or that it is correct to use those words in that way. For instance, I found many examples of “singularly or together” and “singularly or jointly” being used to mean “singly or together” or “singly or jointly”, before I remembered that “singularly” does not mean “singly” or “individually”, but that means “in a remarkable or strange way”. In other words, I had simply found a number examples of the word “singularly” being used incorrectly by people who had mistakenly assumed that “singularly” was synonymous with “singly”, which merely indicated that the mistake was a common one, but did not mean that the mistake was not a mistake.

My point is that one could hardly mistake the meaning of, for example, "fraud that was committed jointly and severally". Actually, here's a catch where the aforementioned quote appears as is, verbatim: http://kenyalaw.org/caselaw/cases/view/98604/

I searched for "committed jointly and severally" (withing quotation marks), and did find quite a few examples. There are, of course, cases where this is said in terms of some kind of commitment, but there are also cases where it is meant in reference to offences, "committed jointly and severally".

The term “jointly and severally” is used to apply to liability, not to the commitment or perpetration of an offence or misdemeanour.

in the present case it is NOT about liabilities (Joint or several)e.g. In cases of joint and several liability, a person who was harmed or wronged by several parties could be awarded damages and collect from any one, several, or all of the liable parties, but about deceit (collective or individual deceit) that´s why I suppose κατά μόνας in the present case means committed by a single Person; but without sufficient Expertise in the field ,my confidence Level is bound to be low.
