Contexte : Il giudicato sostanziale (art. 2909) c.c.) - che fa stato ad ogni effetto tra le parti in ordine all'accertamento, positivo o negativo, della sussistenza del diritto controverso, ed opera entro i limiti degli elementi costitutivi dell'azione, presupponendo che tra la precedente causa e quella in atto vi sia identità di soggetti, oltre che di "petitum" e di "causa petendi" - ha effetto preclusivo solo con riferimento al contenuto ed all'oggetto della pronunzia definitiva - avendo riguardo all'avvenuta affermazione, ovvero negazione, ad opera della stessa, del diritto azionato e quindi del bene preteso - indipendentemente dalle ragioni e dalle motivazioni enunciate a fondamento della decisione.
