Sofern ein Testament in einem Nachlassgericht (oft Teil des Amtsgerichts) verwahrt wird, muss das Gericht die Erben und Beteiligten zur Testamentseröffnung laden. Um die Sache zu beschleunigen, wird jedoch häufig auf diese Ladung verzichtet, und in solchen Fällen erhält das Testament dann einen Eröffnungsvermerk des Nachlassgerichts. (Außerdem wird ein gerichtliches Protokoll über die Testamentseröffnung erstellt, von dem allen Beteiligten eine Abschrift zugesandt wird).
Der eigentliche Vermerk sieht etwa so aus:
Eröffnet am 20. August 2016.
Amtsgericht Berlin-Charlottenburg.
Schmidt, Justizinspektorin
als Urkundsbeamtin des Nachlassgerichts
Manchmal liegen dem fraglichen Testament noch andere –nicht eröffnete- Unterlagen, z.B. das Testament eines Ehegatten bei, und das wird dann ebenfalls in dem „Vermerk“ festgehalten.

I understand that the will has been opened in Court and that there is a note on the will attesting to it.
