An order is perfected when the High Court Registrar who is the registrar in the case affixes the High Court seal to the Order as drawn up and drafted by him or her. The Order will be dated by the High Court Registrar before it is perfected. However, you can in certain circumstances get leave without a perfected order. One example would be where there was particular urgency about the case, such as a person going to die, or an abortion about to take place. However, in all other cases, you have to await the perfecting of the Order by the High Court Registrar before you can move forward on the basis of the perfected order. JACUSTOMER-1aqkfnwe- : What is a high court seal? How can I tell if there is a seal on my order? If the order is not dated does that mean JACUSTOMER-1aqkfnwe- : Its not perfected? Customer: 2. A High Court seal is the imprint on the document made with a STamp. It is usually circular in size and embosses the document with an imprint which states "Ard Chuirt" in it. You will have to have an original Order to have a seal on it. A copy will not clearly show it. Secondly, all orders have the date on it. If the date has not been inserted you should go back to the relevant High Court Registrar and point out the error, as all Orders have to have a date on them. JACUSTOMER-1aqkfnwe- : And what can you do if the registra refuses to rectify the error and place a date on the order - what action can then be taken? Is the court obliged to provide me with an original sealed and dated order? Customer: 3. If the Registrar refuses, you simply re-enter the matter before the judge who dealt with the case and "speak" to the order, whereby the judge authorises amendments to the order, including the insertion of the date. Secondly, you are entitled to an original sealed and dated order, provided you are the first of the parties to the litigation to take up the order. Essentially, there is only one original order and it is the first party to the litigation who takes up the order who gets the original. So you need to ensuer the other side did not take up the order first. If they did so, then you can only get a copy of the original. But that is sufficient to get leave from the Supreme Court.
