3.1 These GPC establishes the general terms and conditions for the purchase of Products by XX to Supplier which shall be sent by XX together with the Frame Order (as defined below) or, if applicable, the Purchase Order (as defined below).

Supplier acknowledges and agrees that if the information contained in the Delivery Schedule does not contradict the Frame Order, then the Delivery Schedule shall be automatically binding to Supplier with no need to have it expressly accepted by Supplier.

Supplier acknowledges and agrees that the acquisition by XX of the Products shall be articulated either by the Rolling Forecast System (as per Section 5 below) or by the Purchase Order System (as per Section 6 below) and the decision will fall exclusively to XX at the time of launching the Frame Order or the Purchase Order.
