En los casos en que, luego de notificado fehacientemente, el oferente o adjudicatario no retirase las garantías, éste
podrá reclamar su devolución dentro del plazo de 1 año a contar desde la fecha de la notificación. La falta de
presentación dentro del plazo señalado por parte del titular del derecho, implicará la renuncia tácita del mismo a
favor de la empresa, pudiendo esta última ordenar el ingreso patrimonial de lo que constituye la garantía o en su caso proceder a la destrucción del documento presentado.
