Hi all,

I'm translating an article regarding a complaint for sexual harassment and could not find an equivalent for Acta de archivo. The Public Prosecutor decides to take no further action on a complaint and asks the complainant's solicitor to sign a certificate of acts de archivo. Source country is El Salvador Target country is UK

Dismissal is a US term. If the translation is for the UK, I think this is the nearest equivalent. Apparently an acta de archivo is signed by the complainant. This is not the case with a notice of discontinuance, though the victim of the crime in question has to be notified and has the right to have the decision reviewed.

agree  philgoddard: I'm the proud holder of a Nolle Prosequi for a traffic charge. I'd never heard of the phrase, but everyone here in the States seems to know it.

  -> Good for you! I'd heard of it, but I can't say I knew exactly what it is. Apparently it has to come from the Attorney General in Britain.

Procedure

In the Crown Court the judge has the power to order that entire indictments or some counts on an indictment are ordered to 'lie on the file'. There is no verdict, so the proceedings are not formally terminated. There can be no further proceedings against the defendant on those matters, without the leave of the Crown Court or the Court of Appeal.

The consent of the judge is required to leave an indictment or counts to lie on the file. In practice, the judge usually consents, provided that the defence agrees.

The procedure is particularly useful when:

the defendant has pleaded guilty or has been convicted of other counts in the same indictment; or
the defendant has pleaded guilty or has been convicted on counts on another indictment; and
convictions for the remaining offences would have no significant impact on the sentence; and
it is no longer in the public interest to proceed on the remaining matters.

In United Kingdom law, a criminal charge is allowed to lie on file when the presiding judge agrees that there is enough evidence for a case to be made, but that it is not in the public interest for prosecution to proceed, usually because the defendant has admitted other, often more serious, charges.[1]

No admission to the charges is made by the defendant,[1] and no verdict recorded against them.[2]

Charges which have lain on file may be reinstated at a later date, but only with the permission of the trial judge or the Court of Appeal.[1]

Charges which have been laid on file have on occasions been taken into account in actions under the Proceeds of Crime Act 2002, to confiscate the gains of criminal activity.[2] The legal commentator David Winch has argued that this is in breach of the presumption of innocence.[2]

De los diecinueve (19) casos archivados, nueve (9) se encontraba regidos según el Código de Procedimiento Penal, ley 906 de 2004, que comienza a regir a partir del 1 de enero de 2005, en este periodo de tiempo se encontró que en un (1) expediente judicial no fue posible determinar la fecha de cierre del caso.

La denuncia de xx en Fiscalía General de la República nunca se judicializó y ella aún espera respuesta a su denuncia, en cambio, la acusación presentada por xx fue directamente ante los tribunales competentes en donde se le dificultó probar sus alegaciones dado que Fiscalía manejó con total hermetismo su denuncia y decidió archivarla sin mayores explicaciones, solicitándole firmar ****el acta de archivo **** sin dejar que ella en su calidad de víctima la leyera y mucho menos que su abogado o abogada lo hiciera para posteriormente asesorarla.
