La Sala de lo Constitucional de la Corte Suprema de Justicia (CSJ) admitió una demanda, interpuesta por familiares de un grupo de personas asesinadas en 1981 en Tecoluca (San Vicente), por la supuesta omisión de la investigación por parte de la Fiscalía General de la República (FGR).

Para la Querella resulta sospechoso que el Fiscal General ordenara una investigación previa a judicializar el caso, bajo el concepto del delito de lavado de dinero, dado que la fiscalía solicitó en 19 países la existencia de cuentas bancarias pertenecientes al imputado Flores.
Sin embargo, pese a que el Fiscal realizara esta investigación, el delito de Lavado de Dinero no fue presentado al momento de judicializar el caso.
Ante esto, el Juez Séptimo de Instrucción ordenó recientemente a la FGR explique porque se realizó una investigación previa, pero no se judicializó el delito contra el imputado.
“El Fiscal General podría caer en el delito de omisión de investigación ”, agregó Campos, debido a ocultar dicha información.

El concepto de omisión resulta más fácilmente comprensible de su comparación con la noción de acción; resultando ambos, en definitiva, conceptos que pertenecen a un mismo plano y que el Código Penal (en adelante C.Pn.) los diferencia en el Art. 19: "Los hechos punibles pueden ser realizados por acción o por omisión". Es así que la conducta humana, como reflejo de una voluntad dirigida a la consecución de un fin, expresa básicamente los tipos de penales por medio de prohibiciones y en ciertos casos lo hace por mandatos.
Se encuentran varias diferencias entre el tipo de acción y el tipo de omisión, lo cual mencionamos en cuanto a su estructura, la acción se realiza si se efectúa la conducta que describe, por otro lado la omisión se constituye con la no realización de una determinada conducta; también afecta el significado normativo ya que en el injusto del delito de acción se realiza una conducta contraria de una norma prohibitiva; la omisión consiste en hacer algo distinto a la prestación deseable obligada en principio por una norma preceptiva (supra).[1]

The crime of omission presents a complex problem in the study and analysis of modern dogmatic, and we understand that a short course will help little by little, to clarify an issue that has not been dealt with depth and analysis it deserves, with the exception of the great masters of Criminal Law.We also wanted to make clear that these lines just trying to highlight the essential aspects of the crime has ignored, with the utmost simplicity and unpretentious philosophical. It is noteworthy that the doctrine has not made significant progress in regard to the characteristics and essential foundations of this crime that compared with other institutes of criminal law has not reached the degree of reflection and research analysis it deserves.
