Exclusion clause Explanation: I think that this is a generic phrase for insurance contracts. According to the Business Dictionary, an exclusion clause is a 'Provision in a contract under which one party's liability (that would arise by implication of law) is excused in the listed conditions, circumstances, or situations (called exclusions).' Which means that the contract binds the parties together and that they cannot turn their back on each other. In this case the exclusion clause does not apply in case of theft or ill will. Maybe it works? Reference: http://www.businessdictionary.com/definition/exclusion-claus... |

right of redress Explanation: party A insures his responsibility. In the contract with party B it is stipulated that the counter party in the contractual relation (B), even if it commits an error, is not going to have to reimburse the insurer or party A. |

clause de non recours indemnity clause Explanation: This is an indemnity clause. The Principle of Indemnity To explain an indemnity agreement, it is first necessary to define the term "indemnity." waiver of recourse clause Explanation: The waiver of recourse clause provides that Party A will not sue Party B (e.g. 'seek remedy'). It is different from the hold harmless clause, which says that Party B will be covered and indemnified by Party A if it (Party B) should be held responsible for the consequences of any of Party A’s actions. Please refer to point 1.2 of this reference : http://www.philippelaw.eu/UploadDirectory/UserFiles/files/P&... As usual, I'll leave it to native speakers to say this in better (legal) English. -------------------------------------------------- Note added at 4 hrs (2015-03-11 18:49:31 GMT) -------------------------------------------------- 'waiver of recourse clause against the organisers, the foundation and any other person/thrid party...' -------------------------------------------------- Note added at 1 day15 hrs (2015-03-13 05:48:53 GMT) Post-grading -------------------------------------------------- Thank you, LaraBarnett. May I just add something to what I wrote earlier, for the sake of clarity: … if it (Party B) should be held responsible for the consequences of any of Party A’s actions or for the consequences of its (Party B’s) actions following Party A’s instructions. |
