Spanish to English translations [PRO] Law/Patents - Law: Contract(s)
Spanish term or phrase:Contrato Oneroso de Opción de Compra
I am translating a contract from Spanish into English (UK), what should be the best translation for "Contrato Oneroso de Opción de Compra"? Call Option Contract for Contrato de Opción de Compra, but onerous? Thank you!
if the rest wasn't enough, here it is spelled out:
Most of the onerous contracts are also categorized as reciprocal contracts. Piotr Machnikowski - 2011 - Law books.google.com/books?isbn=9041133968
who classed the contract as in the nature of an onerous or non-gratuitous (see above to understand the contrasting nature of Reciprocal/Gratuitous Contracts) J. P. Van Niekerk - 1999 - Law books.google.com/books?isbn=0702149209
The reciprocal or mutual assent of two or more persons competent to contract. .... in relation to the motive for. making them, are either gratuitous or onerous.
A contract is a synallagmatic or bilateral (or reciprocal) contract when ... An exchange is the very essence of an onerous contract.
The Insurance Contract as a Bilateral, Reciprocal Contract In Roman-Dutch law, the insurance contract was regarded as a bilateral (or onerous
A Reciprocal Contract might involve considerations, but Oneroso doesn't mean a "consideration". It means reciprocity between the parties for benefit and obligation. The function might be described as mutual consideration, but I don't think what you're putting forward is fully correct as a translation of the term.
Teniendo en cuenta que todo contrato implica uno o varios valores económicos: dinero, servicios, bienes inmuebles, o inmuebles, bienes intangibles, etc. Se puede hablar de contrato oneroso o gratuito. Oneroso: Se mira la utilidad de ambos contratantes, gravándose cada uno a beneficio del otro. El oneroso es un contrato conmutativo cuando cada una de las partes se obliga a hacer o dar una cosa que se mira como equivalente a lo que la otra parte debe hacer o dar a la vez. Gratuito: Se mira sólo loa utilidad de una de las partes. Es decir;
Note that onerous is about the reciprocity of benefit and obligation, hence the terminology in English.
Bilateral contracts and Reciprocal contracts are not the same, either in Spanish or English:
Bilateral Contract. An agreement formed by an exchange of a promise in which the promise of one party is consideration supporting the promise of the other
Reciprocal contract is a contract in which the parties enter into agreements mutually, or reciprocally thus making the obligation of one party correlative to the obligation of the other party
The difference is that in Bilateral both parties make promises to each other, where as in Reciprocal they both have obligations they must fulfill, an admittedly fine parsing but such is law.
Not so fast, Traveling. It has various shades of meaning, I have looked it up and I am not amiss. You can fight with my friend Francisco J. Becerra (Dicc. de terminología jurídica mexicana) on this one, plus a good many others. Of course like in the case of "consideration" a contract must impose mutual obligations.

Pls. explain to us then why a contrato oneroso is always contrasted with a contrato gratuito or gracioso. Your comments are always well-supported by authority but - before you bow out - consider this quote: 'El contrato bilateral o *sinalagmático* es aquel contrato que genera obligaciones recíprocas para ambas partes contratantes.'

It is unfair of you to omit the context, namely what the target of the option is for UK consumption: for instance > land (a registerable C(iv) estate contract for valuable consideration in conveyancing) vs commodities or futures, namely a call option agreement supported by valuable consideration.
One would think so, because purchase is by definition for consideration, plus it is a requirement for a contract to exist. But then we just translate what is there.
Explanation: A contrato oneroso, is actually a type of contract wherein both parties must enter into mutually obliged terms of benefit and obligation:
In English this is a Reciprocal Contract: RECIPROCAL CONTRACT, civil law. One in which the parties enter into mutual engagements. legal-dictionary.thefreedictionary.com/Reciprocal+contract

Contrato Oneroso is a set term, it is a type of contract.
Tom's disagree fails to understand this or the nature of what it means.
It is by definition a Reciprocal Contract, and this does not mean both Parties have the option to buy, that is just a plain failure to understand the nature of what a reciprocal contract is.
