I'm translating an agreement concerning the registration of xxx's promissory note with a bank and am stuck on "saisir hors les livres de la banque" in the sentence that follows: 'Pour le cas où surviendrait une décision de justice ou une mesure de toute nature émanant de toute administration habile à agir, rendue opposable à la Banque et dont le résultat serait de grever la Reconnaissance de Dette dans les Livres de la Banque et/ou de le **saisir hors les Livres de la Banque**, xxx accepte sans réserve que la Banque porte au débit du compte tous frais exposés par la Banque à la survenance d’un tel évènement, de ses suites et conséquences". Could this mean 'confiscated from the Bank's books'? Thanks in advance if you're able to help me with this.

Explanation:
Perhaps for example if a house which is security is appropriated by a court?
That would incur costs for the bank as the house is security and therefore there is going to be a lot of renegotiation by the bank with the client and perhaps charges for the increased risk

disagree  AllegroTrans: Itr's not about "seizing" anything - just a registration over an asset to secure a liability// the decision of a court is "opposable à la banque" (banks are not above the law, despite appearances...)

where capital letters of "Bank Accounts" will be important because in the contract these are probably specified and the use of capital letter makes it explicit.

Explanation:
It seems to me that context is whereby a decision has been made in court which challenges the enforceability of the debt as held by the bank and recorded in their books.

It must therefore be recorded elsewhere and "off-the-books" of the bank.
