English term or phrase: recital

A recital is merely a record of an agreement reached or an event that's happened. It goes on the court record, and can be used as evidence if one party to the case later denies it.

An undertaking is much more important. It's given by one party involved in the case to the court, and is effectively a promise to the court to do or not do something.

It has the same effect as a court order. So if a party undertakes to pay Mr X £1,000 within 7 days it's the same legally as if the court had ordered him to do. If he fails to abide by the undertaking Mr X can sue him, and he can also be sent to prison for contempt of court.

A recital will often record an undertaking that's been given - for example:

"Upon the Petitioner undertaking to the Court and to the Respondent to transfer ownership of a Ferrari motor car registration number BEX 1 to the Respondent within 14 days from the date of this Order..."
