required characterization [description] of intervenor as shareholder [stockholder] Explanation: "Characterize" means to indicate or define the character of; to describe. Example from United States Court of Appeals, Second Circuit. - 413 F.3d 330. Argued: November 12, 2004 Decided: June 30, 2005 Paragraph 53: In his prayer for relief, the Trustee sought "compensatory damages," which is, of course, the classic form of legal relief. The district court, however, "looked beyond [the Trustee's] characterization[] to what the claim for relief actually [was]." Interventor: In law, intervention is a procedure to allow a nonparty, called intervenor (also spelled intervener) to join ongoing litigation, either as a matter of right or at the discretion of the court, without the permission of the original litigants. The basic rationale for intervention is that a judgment in a particular case may affect the rights of nonparties, who ideally should have the right to be heard. However, there is also the figure of the "amicus curiae": An amicus curiae , literally "friend of the court", is someone who is not a party to a case who offers information that bears on the case but who has not been solicited by any of the parties to assist a court. This may take the form of legal opinion, testimony or learned treatise (the amicus brief) and is a way to introduce concerns ensuring that the possibly broad legal effects of a court decision will not depend solely on the parties directly involved in the case. The decision on whether to admit the information lies at the discretion of the court.
