lease for further commercial use Explanation: This is what one of my clients (law firm) uses instead of the term recommended by Dr. Chromá - maybe for those unfamiliar with the Roman law... :-) |

Reference: Pachtvertrag vs. Mietvertrag Reference information: This is exactly the same question. (Pacht, obviously, is from German.) See what our DE>EN colleagues have to say: http://www.proz.com/kudoz/german_to_english/law:_contracts/1... Here is what differentiates a nájemní smlouva from a pachtovní smlouva: “V případě pachtovní smlouvy se na rozdíl od nájmu předpokládá, že pachtýř bude vlastním přičiněním věc obhospodařovat tak, aby přinášela výnos. Z nájemní smlouvy tedy plyne právo věc užívat, kdežto z pachtovní smlouvy plyne právo věc užívat i požívat.” „Lze tedy propachtovat restauraci, dobytek, les či úročenou pohledávku.” http://muj-pravnik.cz/pacht-najem-v-novem-obcanskem-zakoniku... The same applies in German law: „mit der Möglichkeit der Fruchtziehung” http://de.wikipedia.org/wiki/Pachtvertrag_(Deutschland) So, lease agreement? If the situation is specific enough, "agricultural lease", as this is where a pacht will be most common? |
