Explanation:
O Tribunal Constitucional português, acórdão publicado no Diário da República de 02 de Julho de 2002, veio declarar que as prestações sociais ou pensões cujo valor seja inferior ao salário mínimo nacional (SMN) são absolutamente impenhoráveis. Assim sendo os credores de pessoas que não possuam quaisquer outros rendimentos, deixam de poder ser pagos, como até aqui, através da penhora de uma parte daquelas prestações.

Na penhora de salários o tribunal terá em conta as necessidades do executado, em termos de alimentação, rendas ou pagamento de empréstimos imobiliários e de despesas regulares, como a electricidade. Esta é a chamada “parte impenhorável dos rendimentos”. Caso o executado ganhe mais do que a parte impenhorável dos rendimentos a execução prosseguirá.
