III EU Directive
This Directive allows a company regularly authorized to operate in any of the countries of the European Union, to offer its services in all the other countries without the obligation of further authorizations on conditions that it does not establish secondary offices in such countries, i.e. in a Free Provision of Services regime. This directive was also transposed into Italian Law by Legislative Decree no. 174 of 17th March 1995.

An additional adjustment could be to allow companies which meet the other terms and which pursue an activity by way of the freedom to provide services in a Member State which has also signed an IGA, to be treated as deemed-compliant. Indeed, without this adjustment, some companies of national dimension couldn't benefit from the scheme. In our view, cross-border activity is really incidental should not disqualify the companies.
