megbizói felelősség továbbháritása záradék Explanation: Kontinentális polgári jogban a megbizott a megbizási dij ellenében köteles a megbizó ugyeinek vitele érdekében, annak szolgálatában eljárni. Ugyanakkor a megbizott, azaz fővállakozó a megbizás teljesitése érdekében gyakran vesz igénybe alvállakozókat. A klauzula egész egyszerűen kiterjeszti a megbizott megbizó irányába fennálló polgári jogi felelősségét, az alvállakozóra is. Az alvállakozó is ugyanolyan felelősséggel tartozik. Azaz a felelősséget lentebbi szintre is delegálja a jogviszonyban. |

It may also be referred to as a pass-through or conduit clause. They are most common in construction contracts. Such provisions state that the subcontractor is bound to the contractor in the same manner as the contractor is bound to the owner in the prime contract. Flow-down provisions help to ensure that the subcontractor's obligations to the contractor mirror the contractor's obligations to the owner. |
