El recurso de agravio constitucional es un medio impugnatorio que interpone el afectado con un derecho constitucional ante la denegatoria en segunda instancia de su demanda constitucional (amparo, cumplimiento, etc.). Este recurso no tiene requisitos especiales para su interposición, esto significa que es libre de hacerse en el entendido que los procesos constitucionales hacen primar el fondo a la forma.
