Quanto ao órgão jurisdicional de reenvio, esse poder discricionário está previsto na Section 35A(1) do Senior Courts Act 1981: «[...] num processo [...] de cobrança de uma dívida [...] os montantes atribuídos pela decisão podem ser acrescidos de juros simples, à taxa que o tribunal considerar adequada, em relação à totalidade ou a parte da dívida [...] e pela totalidade ou parte do período decorrido entre a data em que se constituiu a causa de pedir e [o pagamento ou a decisão]».
138. As regards the referring court, such discretion is provided for in section 35A(1) of the Senior Courts Act 1981: ‘… in proceedings … for the recovery of a debt … there may be included in any sum for which judgment is given simple interest, at such rate as the court thinks fit, on all or any part of the debt … for all or any part of the period between the date when the cause of action arose and [payment or judgment]’.
