Už dlhšiu dobu sa trápim s výrazom "bail", "to be released on bail". Slovníky uvádzajú ako preklad "kaucia", ale ten sa mi nepozdáva lebo evokuje peňažnú záruku, čo v praxi nie je vždy pravda. Má niekto nejaký iný vhodný preklad?

In England and Wales there are three types of bail that can be given:

- Police bail where a suspect is released without being charged but must return to the police station at a given time.
- Police to court where having been charged a suspect is given bail but must attend his first court hearing at the date and Court given
- Court bail where having already been in court a suspect is granted bail pending further investigation or while the case continues.

Mate pravdu v tom že kaucia je záruka v peniazoch al. aj cenných papieroch ( v cennych p. , nie je vas pripad)

bail - security, usually a sum of money, exchange for release of an arrested person as a guarantee for that person's appearance for trial.

"usually sum of money", lebo to nemusia byt len peniaze ale aj na čestne slovo, to vsetko zavisi od priestupku...

nie moj predmet ale mozno vam to pomoze

Vraciam sa k tejto otázke pretoze som este nestihol dolozit zdroje, kt. uvadzam.
Existuju viacere pravnoporadenske stranky, kt. definuju 'bail' ako sa chape v UK systeme

Teda je to písomný slub alebo záruka súdu, ze sa dostavíte na ten a ten den.

Reference information:
Možno stojí za povšimnutie, že v slovenskom Trestnom zákonníku ani Trestnom poriadku slovo „kaucia“ nenájdete. Existuje „Nahradenie väzby zárukou, sľubom alebo dohľadom“ (§ 80 Trestného poriadku) a v tej istej súvislosti aj „peňažná záruka“ (§ 81).

Je mi jasné, že pri veľkej väčšine textov nie sú slovenské právne reálie v tomto smere príliš relevantné. Zároveň sa však určite nájdu texty, v ktorých sa namiesto notoricky známeho slovníkového prekladu („prepustiť na kauciu“) dá uspokojivo použiť niečo tvorivejšie a pre slovenské oko a ucho prirodzenejšie, napr. to, čo navrhuje Rad.
