The above is extracted from the minutes of a contract negotiation meeting.

I do not know 1. if the Abstandszahlugnen are meant to be just another term for Ausfallentschädigungen (probably not) and 2. what the appropriate English translation would be for the latter anyway.

the text seems to say that NEGOTIATIONS with third parties about those things would be considered anti-competitive. That doesn't affect the meaning of the term(s) you have asked about. Perhaps, you might start your sentence something like this:

Asker: Michael: Your suggestion does come closer to what I understand the meaning of A. is. However, don't you detect a little negative connotation in the German text? I do, and I just don't know how I should express this in the translation. Thank you, Antoinette
