This is in an insurance manual I am translating (for a multinational based in France; target language EN UK).
The term "règle proportionnelle" has already cropped up as a Kudoz question (eg http://www.proz.com/kudoz/1061338, where contributory negligence is involved), but I have doubts about the "de capitaux" bit in the present case.
The full text is as follows:
"La ***règle proportionnelle de capitaux*** est entièrement abrogée pour l'ensemble des garanties de la police.
Cela signifie en pratique que l’Assureur ne pourra pas réduire l’indemnité due en cas de sinistre en raison d’une éventuelle sous-évaluation des capitaux, pour autant que la sous-évaluation ait été de bonne foi.
Il convient donc de procéder à une déclaration des valeurs aussi proche de la réalité du risque que possible et s’assurer notamment que les valeurs Bâtiments et Contenu soient bien déclarées en valeur à neuf."
This seems to be a different notion than "contributory negligence", or am I missing the point entirely?
