Su funcionamiento general consiste en que todos los documentos que afecten a un inmueble deben ser archivados en el registro y el registrador debe llevar un índice de esos documentos, que permita a los interesados verificar los antecedentes de un inmueble. En la mayoría de jurisdicciones de los Estados Unidos, los registros públicos llevan un índice en base a los nombres de las partes contratantes, mientras que solo unos pocos estados mantienen sus índices con base a la propiedad de que se trate.
