Explanation:
I can’t find references to link, but this for my money is the best-understood English equivalent. Avoid ‘derived right(s)’ or similar because that means something almost straightforwardly opposite: rights obtained by an authority as a secondary process through legislative/regulatory channels.

Alternatively, you might care to recast the clause so as to state that the electorate has assigned/mandated the right(s) to the body in question.

=>
"such a right (to bring a new Constitution) would be derived from / based on the legitimacy given to it by the direct mandate from the citizens"
or
"such a right (to bring a new Constitution) would be made legitimate by the direct mandate given to it by the citizens"

Ustav normalno donosi "Ustavotvorna skupština", posebno ustanovljena radi usvajanja novog ustava, što je ovde slučaj.
Takva skupština ima direktan mandat gradjana da donosi ustav, upravo je za to izabrana.
Njeno pravo da donosi ustav je zasnovano na mandatu gradjana / proističe iz mandata gradjana.

Autor je to ovde prikazao u dve etape: prvo gradjani daju legitimitet ustavotvornoj skupštini, a u sledećoj etapi iz tog legitimiteta proizilazi / proističe / izvodi se njeno pravo da donosi novi ustav.

Ne vidim zašto bi se to u prevodu prikazalo drugačije, i izbacilo pominjanje "legitimiteta".
