French term or phrase: aux termes duquel le constituant s’entend
I am not quite sure how to work this part into the English translation. Any suggestions? French to English.

les trusts sont constitués par une entreprise ou un groupe d’entreprises pour leur propre compte et le constituant ne répond pas à la définition fixée par le 2 du I de l’article 792-0 bis du CGI aux termes duquel le constituant s’entend, lorsque le trust a été constitué par une personne physique agissant à titre professionnel ou par une personne morale, de la personne physique qui y a placé des biens et droits.

-the trusts are formed by a company or group of companies for their own benefit and the constituent does not meet the definition outlined by section 2 of I of article 792-0 bis of the GTC of the terms of which the constituent is understood, when the trust was formed by a physical person acting as a professional or by a corporate body, of the physical person who has place the good and rights there.

FONCTIONNEMENT
Le trust est un contrat (Trust Deed) selon lequel une personne, le Settlor (constituant) cède la propriété d’un actif à un Trustee qui le conserve et le gère afin de le remettre, généralement au décès du constituant ou à une date fixée à cet effet, à un ou plusieurs Beneficiary.

You definitely can't translate "constituant" as "constituent".

For "s'entend", a fairly complex usage of the verb "entendre", see here:
