Russian to English translations [PRO] Bus/Financial - Law: Contract(s)

"Заказчик оставляет за собой право отказать в заключении договора в случае выявления признаков, позволяющих отнести победителя тендера к статусу «Транзитер», «Налоговая яма» и пр, имеющими признаки сомнительных операций или при выявлении таких признаков у его контрагентов или у участников цепи поставки товара (субподрядчиков по выполнению работ)."
Мне нравится tax dump а также tax hole. Мне кажется они действительно ассоциируются с тем местом, где пропадают или недополучаются государством налоги. А вот tax pit таких ассоциаций как-то не вызвает.
"Pit" is too neutral for me. "Tax Dump" has at least some connotation with "налоговая помойка" that in the language of the lawyers authoring the document has become "налоговая яма".
Or, just as an idea... May be, we should continue searching among the four-letter rather than three-letter words?
Since such a term does not seem to exist in the english language (A+ to the Russians for creativity), maybe just the literal "tax pit" translation could work?
If someone were to create a short term shell company for the purposes of tax evasion in the US, would it not fall under the category of an abusive tax shelter? A tax shelter is ANY method of reducing one's taxable income. Well, this is one of the methods apparently :) I understand that a налоговая яма is not "exactly" the same thing, but I really don't know of a better term to describe it.
Tax shelter is simply a method of reducing one's taxable income thus reducing one's tax liabilities. Some of these methods are absolutely legal and have been used for decades by the rich (primarily) and the poor. Only when the government believes certain programs are pushing the envelope too far while experimenting with the established methods of tax minimization or too aggressively exploring gray areas of the tax code it brands such endeavors "fraudulent" or "abusive" and goes after them. There are usually live people with the real names and addresses behind even most "creative" (or "abusive," you pick) tax shelter schemes.
On the other hand, "налоговая яма" is a sheer fraud from the get go. With the bells and whistles of a purportedly legitimate company, the life cycle of such entities does not exceed three to six months. They are specifically created to quickly accumulate various tax liabilities and then expire. However, the government's attempts to place their creators in a safe, secure and confined environment are rarely successful since these companies are either headed by the "front men" or registered to non-existing individuals.
вариантом перевода. вот только я никогда такого выражения не слышала. а price dumping (ссылка, которую вы привели) к этому отношения не имеет, поэтому я и спрашивала, как вы эти термины увязываете.
Я ничего ни с чем не связываю - предлагая свой вариант (как правило - быстро), я перевожу "по наитию" (правда, проверяя и перепроверяя себя пользуясь всеми возможностями Интернета).
На мой, imho, взгляд, "яма", в контексте русской литературы, вызывает вполне определенные ассоциации.
С другой стороны, я вполне могу предположить [исходя из контекста исходника], что нынешние российские lawyerы, не читав русской классики, вознамерились "облагородить" обычный в нынешней ХХХ термин "налоговая помойка" благородным выражением "налоговая яма", несколько забыв о стихотворении А.Галича, начинавшемся словами: "Всё было пасмурно и серо, пейзаж стоял как неживой, и только..."
связываете. На мой взгляд (пока не знаю нужного термина), это один из видов shell company, созданная исключительно для уклонения от налогов. Я просто в Америке с соответствующим этому русскому термину английским словом никогда не сталкивалась. Не то, чтобы у нас такого не бывает, просто не приходилось сталкиваться. Я с нетерпением жду знатоков налоговой области. Самой интересно.

В царской России неплательщиков НАЛОГОВ сажали в "яму", т.е. что-то типа "карцера" (реально - погреб), где они сидели до тех пор, пока кто-либо не захотел их выкупить (т.е. выплатить за "сидящего" налог).
Когда я был в Лондоне, аналогичные "заведения" там, рассыпанные по всему городу (разумеется, сейчас - музеи) - назывались "dungeon".
Imho. Может я и ошибаюсь?
