2.5 End User Agreements and Warranties; Responsibilities. The Parties acknowledge that, if required given the structure of Expert’s relationship with an End User, Expert may *click-through* the End User Agreement (for example, as part of Expert’s installation of the Software for the End User); however, in all such cases, Expert will ensure that the End User separately agrees, in writing to the terms and conditions of the End User Agreement on its own behalf, and upon written request by A, Expert will promptly deliver to Atlassian evidence of such End User’s entering into the End User Agreement. Without limiting the foregoing, all warranties made by A with respect to the Software and/or Hosted Services are made directly by Atlassian to the End User in accordance with the End User Agreement, and Expert is fully responsible for all liabilities and expenses of any type whatsoever that may arise on account of its activities hereunder (except to the extent resulting from the negligence or willful misconduct of A), including providing unauthorized representations or warranties to End Users or otherwise breaching any term, representation or warranty of this Agreement, and Expert will be responsible for and indemnify A against all claims, damages, settlements, expenses and attorneys' fees incurred by A with respect to such activities.

Речь, на мой взгляд, идет о том, когда ПО на компьютер устанавливается не самим Конечным пользователем, а сторонним специалистом.

Т.е. фраза imho гласит:
...Специалист вправе пропустить шаг подтверждения согласия с условиями Соглашения с конечным пользователем (например, в ходе установки Программного обеспечения Специалистом для Конечного пользователя); однако, во всех таких случаях Специалист обеспечит, чтобы Конечный пользователь дал отдельное согласие в письменной форме с положениями и условиями Соглашения с конечным пользователем...

На практике, при установке обычного ПО "проставление галочки" согласия с условиями СКП является обязательным, но в данном случае - ПО компании Atlassian Software Systems - предусмотрена возможность пропустить этот шаг, но по письменному запросу Atlassian Специалист должен будет передать им соответствующую бумажку за подписью Конечного пользователя.
