In personam
Latin: All legal rights are said to be either in personam or in rem.
An in personam right is a personal right attached to a specific person, such as contract rights, a tort award against a defendant, or a license.
In rem rights are property rights enforceable against the entire world (such as property rights) whereas an in personam judgment binds only the litigants.

Dingliche Rechte sind also absolute Rechte. Daraus ergibt sich eine Ausschliessungsbefugnis:
Der Berechtigte ist befugt, Dritte an der Einwirkung auf die Sache zu hindern.
Ausnahmsweise werden bei einem subjektiven Recht dingliche und obligatorische Elemente verknüpft, so dass das persönliche Recht eine dingliche Komponente aufweist. Dann spricht man von einer Realobligation.

Hinter dem Besitz steht stets auch eine andere Rechtsbeziehung zu der betreffenden Sache, regelmässig ein dingliches oder obligatorisches Recht (z.B. ist der Besitzer auch Eigentümer, Mieter, Nutzniesser, Dieb…)

Obligatorisches (persönliches) Rechtsverhältnis: Vertrag über Gebrauchsleihe oder Miete. Obligatorische Rechte wirken jedoch nur gegenüber dem Vertragspartner!

Hi Tim. Does the headnote relate to this judgment? On reading the case and looking at the provisions of Swiss and Liechtenstein law cited, it is clear that we are in the realm of (real) property law. As you rightly point out, the sentence concerns who can be the proper defendant. The owner [eigentümer], persons with certain rights in rem [presumably holders of easements or similar] and persons with rights in personam or contractual rights.

It seems very strange to say that a person is "indirectly entitled to be sued", which is the overall meaning of the sentence where the phrase occurs, were we to go with this translation.

I am not absolutely sure, but I generally take "passivlegitimation" to mean the object of a suit, i.e. able to be sued or one against whom suit can be brought under federal laws. And I take "aktivlegitimation" to be the opposite, one who brings the suit, i.e. able to file suit against someone as defined under federal law.
What do you make of it?

It's true that obligatorisch can mean compulsory, and that's the impression Google gives, but for example Dietl-Lorenz law dic has obligatorischer Anspruch: claim based upon contract/ tort. In the present context, 'under the law of obligations' (or 'in contract or tort') makes most sense, while 'compulsory' makes no sense at all!

Nachbar im immissionsschutzrechtlichen Sinn ist zum einen auch der nur
obligatorisch Berechtigte zum anderen auch jemand, der nicht unmittelbar auf dem angrenzenden Grundstück wohnt.

Daher soll ein nach § 47 II 1 VwGO a.F. noch antragsbefugter (lediglich) obligatorisch Berechtigter (Mieter, Pächter) nunmehr nicht mehr antragsbefugt sein
