In cazul declararii insolventei sau falimentului, se cerceteaza tranzactiile efectuate de debitor in perioada de dinaintea declararii (intinderea acestei perioade difera de la o tara la alta) pentru a se constata daca nu a favorizat un anumit creditor in defavoarea celorlalti. In cazul in care se constata o astfel de situatie, se dispune anularea tranzactiei respective si recuperarea sumei sau a bunului imobiliar in vederea introducerii lor in masa credala.
