Precognition in Scots law is the practice of taking a factual statement from witnesses before a trial is enjoined. This is often undertaken by trainee lawyers or precognition officers employed by firms. Many of these are former policemen.

  -> Nieprawda, adwokat i prokurator też przesłuchują świadka (tu: powoda/pokrzywdzonego) - wystarczy wpisać w Google "przesłuchanie sądowe", "przesłuchanie w sądzie" itp., aby się o tym przekonać. Ergo, komentarz błędny merytorycznie.

neutral  Polangmar: 1. Dalej w zdaniu mamy "statement" - i to jest właśnie oświadczenie - pytanie jest o "precognition". 2. Fraza "nie ma nic wspólnego z czynnościami policji i prokuratury" jest bezprzedmiotowa, bo w sądzie też są przesłuchania (świadków).

When carrying out precognition of witnesses, whether personally, through directly employed staff, or through external precognition agents, the nominated solicitor or instructing solicitor is responsible for the manner in which contact is made with the witnesses and the manner in which the witnesses are actually precognosced. In particular, it is the duty of the solicitor to ensure that any matters associated with the witness of which he is aware which would affect the taking of the precognition or the mode of contact, such as age, disability or other vulnerable status, are taken into account by him and communicated to any precognition agent.
