and is not therefore employee of xx Explanation: Ya. -------------------------------------------------- Note added at 6 hrs (2011-02-10 17:48:02 GMT) -------------------------------------------------- This is common wording to make it clear that one party is NOT the employee of the other, that they are independent contractors, and consequently the former will not be liable for obligations of the latter, which he would be if the former were his employee. It is very common in all sorts of agreement to avoid a holding of an employment relationship. -------------------------------------------------- Note added at 6 hrs (2011-02-10 17:59:39 GMT) -------------------------------------------------- Here's a couple of examples of use of very common phrase: "Debe quedar claro, en cualquier caso, que la exclusión del contrato de trabajo es respecto de los clientes o público receptor de los servicios, pero perfectamente este tipo de trabajadores podría estar inserto en una empresa y depender laboralmente de un empleador."
